Terms of Service

These Terms of Service (the "Terms") govern access to and use of the Poliris platform available at poliris.io and app.poliris.io (the "Service") and the Poliris WordPress plugin (the "Plugin"), operated by FCFD, a French limited liability company (SARL) with a share capital of €100, registered with the Sarreguemines Trade and Companies Register (RCS) under number 940 441 876, having its registered office at 12 rue Saint-Blaise, 57460 Behren-lès-Forbach, France ("Poliris", "we", "us").

By creating an account, subscribing to the Service, or installing the Plugin, you ("Customer", "you") agree to these Terms. If you accept on behalf of a company, you represent that you are authorized to bind it.

1. The Service

Poliris is a B2B software-as-a-service platform for SEO auditing and Generative Engine Optimization (GEO/AEO), measuring and improving brand visibility in search engines and AI answer engines. The Service includes website audits (performed by crawling publicly accessible pages of the websites you configure), visibility and sentiment analytics, AI-assisted content and fix generation, and, optionally, the Plugin described in Section 6.

2. Account

You must provide accurate information when creating an account and keep your credentials confidential. You are responsible for all activity under your account. The Service is intended for professional use only.

3. Subscription and fees

3.1 The Service is provided on a subscription basis. Applicable plans, features, and prices are those displayed at the time of subscription or set out in an order form.

3.2 Fees are payable in advance for each billing period and are exclusive of applicable taxes. Payments are processed by our payment processor.

3.3 Subscriptions renew automatically for successive periods of the same length unless cancelled before the end of the current period. Cancellation takes effect at the end of the period already paid; fees already paid are non-refundable except where required by applicable law.

3.4 We may revise prices for subsequent billing periods with at least 30 days' prior notice.

4. Customer content and data

4.1 You retain all rights to the websites, content, and data you submit to or connect with the Service ("Customer Content"). You grant us a non-exclusive license to host, process, and analyze Customer Content solely to provide the Service.

4.2 You are responsible for having the necessary rights to the websites and content you connect to the Service, and for the lawfulness of Customer Content.

4.3 Output generated with the assistance of AI models is provided as a draft for your review. You are responsible for reviewing, editing, and approving any output before use or publication.

4.4 Personal data is processed in accordance with our Privacy Policy. Where we process personal data on your behalf, a Data Processing Agreement is available upon request and forms part of these Terms once executed.

5. Acceptable use

You must not: (a) use the Service on websites you are not authorized to manage; (b) attempt to probe, disrupt, or circumvent the security of the Service; (c) resell or provide the Service to third parties except under a separate written agreement with us; (d) use the Service to produce unlawful, infringing, or deceptive content; (e) reverse engineer the Service except as permitted by mandatory law.

6. WordPress integration (Poliris plugin)

6.1 The Plugin. The Plugin is provided free of charge, is licensed under the GPL v2 (or later), and requires an active Poliris account to function. It acts as a connector between your WordPress site and the Service.

6.2 Authorization. By connecting a WordPress site to Poliris ("pairing"), you authorize Poliris to access and modify that site on your behalf, using a WordPress Application Password that the Plugin creates for the administrator account performing the pairing. You represent and warrant that you are authorized to grant this access for the site concerned.

6.3 Scope of changes. Once a site is connected, Poliris may, exclusively in response to actions you take within the Poliris dashboard: (a) update titles, SEO titles, meta descriptions, page and post content, and image alternative text; (b) create new blog posts as drafts; and (c) apply approved fixes to the HTML rendered by your site, which may include modifying the page markup served to your visitors (e.g. corrected titles, meta descriptions, canonical tags, structured data, or targeted element edits).

6.4 No automatic publishing. Content generated through Poliris is created as a draft and is never published without a human decision on your side.

6.5 Your responsibilities. You are responsible for reviewing and approving each change before it is applied, for the content you approve, and for the effect of applied changes on your live site. We recommend maintaining regular backups of your site.

6.6 Revocation. You may withdraw Poliris's access at any time by revoking the "Poliris Connector" Application Password in your WordPress user profile, disconnecting the site from the Poliris dashboard, or deactivating the Plugin. Doing so immediately prevents any further changes. Upon disconnection, the Application Password stored by Poliris is deleted.

6.7 Third-party dependency. On paired sites, the Plugin contacts the Poliris servers during page rendering to retrieve the list of approved fixes and to send connection-status signals. These requests are server-to-server, identified only by an opaque per-site identifier and a timestamp, and carry no visitor personal data. If the Poliris servers are unreachable or an error occurs, the original HTML of your pages is served unmodified.

7. Intellectual property

The Service, including its software, design, and documentation, remains our exclusive property or that of our licensors. These Terms grant you no rights other than the limited right to use the Service during your subscription. The Plugin's source code is licensed under the GPL.

8. Confidentiality

Each party will protect the other party's non-public information with at least the same care as its own confidential information, and use it only to perform under these Terms.

9. Warranty disclaimer

The Service and the Plugin are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, nor do we guarantee any specific search-engine ranking, AI-visibility, traffic, or business outcome. This disclaimer extends to modifications made to a live website through the Plugin, which you review and approve under Section 6.5.

10. Limitation of liability

To the maximum extent permitted by law: (a) neither party is liable for indirect or consequential damages, loss of profits, revenue, data, or goodwill; and (b) our total aggregate liability arising out of or relating to the Service is capped at the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including gross negligence or willful misconduct.

11. Term, suspension, and termination

11.1 These Terms apply for as long as you maintain an account or use the Plugin.

11.2 We may suspend or terminate access in case of material breach of these Terms, non-payment, or use presenting a security risk, after notice where practicable.

11.3 Upon termination, your data is handled in accordance with the retention periods set out in the Privacy Policy. You may request an export of your data before the end of the retention period.

12. Changes to the Service and to these Terms

We may improve or modify the Service, provided this does not materially degrade its core functionality during a paid period. We may update these Terms with at least 30 days' notice for material changes; continued use after the effective date constitutes acceptance.

13. Governing law and jurisdiction

These Terms are governed by French law. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Sarreguemines, France, notwithstanding multiple defendants or third-party claims, without prejudice to mandatory consumer or local-law protections where applicable.

14. Miscellaneous

If a provision of these Terms is held unenforceable, the remainder stays in effect. Failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any order form or DPA, constitute the entire agreement between the parties concerning the Service.
